One of the people awaiting trial in the death of a local construction worker was back in court today after spending the weekend in jail.
A Roanoke County grand jury indicted both Tracie Nininger and Jeffrey Dupree back in June.
Both are charged with involuntary manslaughter after an accident on electric road left construction worker Richard Sloan dead.
In May, both were found guilty of misdemeanor DUI.
Monday, Dupree was back in court after testing positive for alcohol over the weekend.
According to court records, he blew a .012 Saturday during his daily alcohol test. He says he tested positive because of a certain type of mouth wash he used.
He had a hearing Monday, and the judge released him on bond. He will now have to install an ignition interlock system on any car he drives.
