A Lynchburg judge certified felony charges Thursday against a man accused of shooting a Campbell Avenue Citgo clerk in the head in April.
Kionne Pulley, 20, is charged with aggravated malicious wounding, robbery and two counts of use of a firearm in commission of a felony.
Lynchburg Police Department Investigator Dan Black testified the shooting call came in around 10:30 p.m. April 24. A tip later that night brought investigators to the home of a 17-year-old alleged to have been involved in the incident. A search of his home uncovered a hidden duffle bag in the yard.
Black said investigators found a pistol and sawed-off shotgun used in the robbery inside the bag. The boy also identified the other five involved, including Pulley.
Pulley was arrested the following day and admitted shooting Abderrahin Elfilali. Black said Pulley claimed the gun acci-dentally went off twice.
However, Deputy Commonwealth’s Attorney Chuck Felmlee played a recorded phone call Pulley made from jail on April 26 to an unidentified male. In the call, Pulley tells the man he pointed the gun at Elfilali and told him “he was a goner if he moved,” and that when he didn’t listen, Pulley started “spitting,” at him.
Pulley then made gunshot noises over the phone.
The five juveniles charged in the case are scheduled for a preliminary hearing Tuesday morning in Lynchburg Juvenile and Domestic Relations District Court.
Elfilali has been released from Virginia Baptist Hospital and is recovering, Felmlee said.
