AMHERST —
David Kennedy Martin, 45, of Farmdale Drive was indicted Tuesday on one count each of second-degree murder, a second offense of driving while declared a habitual offender, and driving while intoxicated.
In an interview at the time of the crash, Amherst Police Chief Kenneth Watts reported that on March 14, 2007, Ann Elizabeth Blair and husband Michael John Blair were hit head-on on U.S. 60 in town as they were leaving a restaurant just east of U.S. 29. Witnesses told police Martin was speeding down the highway, ran off the right side of the road and crashed his BMW into the Blairs’ Thunderbird.
Police subsequently reported Michael Blair, 68, died in late April from complications resulting from the wreck and had been hospitalized for nearly a year.
Martin’s drivers’ license had been revoked.
Commonwealth’s Attorney Stephanie Maddox said Wednesday that she could not comment about the facts of the case.
A trial date has not been set. Martin is scheduled to appear before a judge on Oct. 31 to be advised of the charges. Maddox said he is jailed.
