A Campbell County man sentenced to 23 years in prison on federal child pornography charges Friday thanked those who arrested him.

“I’m not sorry I got caught,” Randy Bruffy said in U.S. District Court in Lynchburg. “I’ve done terrible things… I’m happy for the chance to turn my life around.”

Bruffy, 31, pleaded guilty in September to two counts of enticing a minor to produce child pornography and one count of possession of child pornography. He was caught by the Bedford-based Southern Virginia Internet Crimes Against Children Task Force, known locally as Operation Blue Ridge Thunder.

Assistant U.S. Attorney Nancy Healey told the court Friday the investigation showed Bruffy’s involvement in child pornography spanned from November 2008, almost until the day he was approached by investigators two years later.

Healey said Bruffy had more than 600 images of child pornography, including those depicting prepubescent children being raped by animals and infants being abused by adults.

“The public has a sense child pornography is Playboy with children depicted,” the prosecutor said.

“It is not. It is vile and horrible.”

Some of the images included nude photos he made of a 5-year-old boy and a 4-year-old girl — local children whom he gained access to as a trusted friend of their parents, authorities said. Although there was evidence he actively traded other images, there was no proof he showed anyone else the images he made of the local children, the prosecutor said.

For most of the three-hour hearing, Healey and defense lawyer Andrea Harris haggled over what aggravating factors should or shouldn’t be applied to enhance Bruffy’s sentence.

Judge Norman Moon agreed to give Bruffy a harsher sentence because he photographed the children while they were sleeping. Because they slept while being photographed and have no memory of it, they were spared greater harm, Harris said in her argument against the enhancement. 

Moon declined, however, to apply an enhancement classifying Bruffy as a repeat and dangerous sex offender. Healey argued in favor of it, noting Bruffy victimized two different children and actually touched the girl while taking a picture of her as she slept.

The judge said he agreed in principle with the enhancement, but was concerned it had been factored in elsewhere in a presentence report. He said he also was concerned the enhancement would put Bruffy in a category making him eligible for a life sentence.

Bruffy’s crimes were egregious, the judge said, but he noted there would be a severe discrepancy between a life sentence in federal court and a likely sentence of less than 20 years under similar charges in Virginia courts.

“It would be totally unjust in this case to impose a life sentence,” Moon said.

Healey noted she would consider the judge’s ruling and the resulting sentence. After court she said the decision would be made by supervising attorneys in the office and permission to file any appeal would have to be approved by the Department of Justice.
