Roanoke commonwealth's attorney said he didn't think he could win pitbull case in court

Roanoke commonwealth's attorney Don Caldwell said he just didn't feel he could a case involving a pit bull named Trinity in court.

Roanoke police investigated accusations of neglect after the animal had to have its leg amputated following a near two week stay at the Regional Center for Animal Control and Protection, or the pound.

"If I don't think I can prove a case beyond a reasonable doubt then I'm not going to bring it," Caldwell explained.

Caldwell said too many factors played a role in the treatment of the dog while she was at the pound last spring.

Caldwell said he wasn't even sure if he could prove her leg was injured, and that started the deterioration process, or the result of a birth defect.

He also believed money played a role; the pound didn't have enough of it to treat animals like Trinity.

"I'm not blaming anybody," Caldwell said, "but money [was] an issue."

The four local governments involved: Roanoke, Roanoke County, Vinton, and Botetourt County are set to take over operations of the pound in April, ending a partnership with the Roanoke Valley SPCA.

Interviews for the pound's new executive director will begin next week.

Officials said discussions on how to handle veterinary care at the pound will have to wait until the new executive director is in place.
