Lawmaker wants divorce waiting period to be 2 years

Some state lawmakers want to make getting a divorce in North Carolina more difficult.

The Healthy Marriage Act, Senate Bill 518, would make a couple wait two years to have their marriage dissolved rather than the one year that is required by North Carolina law.

The bill would also force couples to receive conflict resolution and communication counseling. If the divorcing couple has a children, the couple must complete a four-hour course on the impact of divorce on children.

Once the couple files for divorce, the new bill would not require the couple to live apart for the two-year waiting period.

Senator Austin Allran (R-District 42) is the main sponsor of the bill. Allran represents Alexander and Catawba Counties. Senators Warren Daniel (R-District 46) and Norman Sanderson (R-District 2) are co-sponsors of the bill.

North Carolina's one-year waiting period to have a marriage dissolved is one of the longest in the Southeast. Virginia and South Carolina also have a waiting period of one year.

If a couple meets the residency requirements in Alabama, a couple only has to wait 30 days from the initial petition for the court to hand down the final divorce notice.
