TAMPA, FL (WFLA) -

If a ban on texting and driving becomes law, it will make Florida the 40th state in the nation to make the practice illegal.

Tampa mom Margaret Murphy-Kearly says it didn't come quick enough.

"It should be a common sense thing, you can't text and drive," Murphy-Kearly said. 

That message apparently didn't get through to the person who hit Jodi Dominguez's son.

"My son was killed by five years ago by a distracted driver," Dominguez told us. 

Dominguez's son had come home on leave from the Navy to visit family when the deadly accident happened.

"He was on his motorcycle, and the distracted driver turned at a light in front of him and took his life," said Dominguez.

Since then, Dominguez has driven around with a sign on the back of her vehicle telling the story of her loss.

"I have to do something positive out of something that was so tragic", Dominguez said.

She says she sees too many people texting behind the wheel in traffic.

"They really need to get people to stop, parents need to start setting a better example for the kids," Dominguez said.  "I look around and I see more parents on the phones, and texting and everything, and their kids are in the back seat, and they are setting the worst example."

Murphy-Kearly says she's spoken to her teenager about the dangers of texting and driving.

She just hopes the new law, if signed, will wake everyone up to the dangers of distracted driving.

Murphy-Kearly also said, "I think eventually the message will get through, I hope so, too many lives, too many young innocent great lives are being taken from us."
