Judge, lawyers discuss jury instructions in McNeill trial

FAYETTEVILLE, N.C. -

The judge and attorneys in the Mario McNeill trial discussed jury instructions Monday morning, including specific wording and charges.

The jury was away from court for what was being called a "charge conference."

McNeill is accused of raping and killing 5-year-old Shaniya Davis in November of 2009. He could face the death penalty if convicted.

Closing arguments are scheduled for Tuesday, but Monday's conference is a necessary step before the jury can deliberate.

By midday Monday, judge James Ammons Jr. had determined the evidence presented by the prosecution means McNeill will face seven charges. They include rape of a child, sex offense of a child, first degree kidnapping, sexual servitude of a minor, human trafficking, indecent liberties with a child and first degree murder.

The prosecution rested its case on Thursday, and McNeill's attorneys called no defense witnesses.

Closing arguments will begin Tuesday and then jury should receive its deliberations instructions on Wednesday.
