Doctor faces Virginia Board of Medicine

Wednesday morning the Virginia Board of Medicine will meet with Dr. Joyce Luteyn as part of an informal conference.

According to paperwork sent to Dr. Luteyn from The Commonwealth of Virginia Department of Health Professions, "A special Conference Committee will inquire into allegations that you may have violated certain laws and regulations governing the practice of medicine and surgery in Virginia."

This review is in connection to a 17 year old patient who was treated at the Med Express on Williamson Road on April 4, 2013.  17 year old Jessica Hart went to the facility for treatment for a sore throat.  She is patient A in the paperwork that was sent to Dr. Luteyn regarding the conference  according to the family's attorney.

Also, from the Commonwealth of Virginia Department of Health Professions outlined in the notice sent to Dr. Luteyn regarding the informal conference,  "You ordered and patient A was administered an intramuscular (IM) injection of 4 mg of Dilaudid (Schedule II), the maximum parenteral dose of that medication, for her reported throat pain, without making any adjustment for this opiate naive patient's age or small size (60 inches tall, weighing 105 lbs, BMI of only 20.5). Moreover, you failed to consider or first attempt non-narcotic medications, less potent narcotics, or the much lower starting dose of Dilaudid, i.e., 1-2 mg, to treat patient A's reported throat pain, nor did you document any pain rating scale with respect to the patient's pain."

After receiving that dose of medication, Hart died a short time later.  T
he Roanoke Medical Examiner determined the Montvale teenager's death was from natural causes.  The investigation into her death was closed by Roanoke County Police.

The informal conference regarding Dr. Luteyn begins at 9:15 Wednesday morning.  WSLS will be there for the facts that come out of that review.  We are told it could take one hour or all day.

The documentation we have from the Department of Health Professions states that after considering all of the information that will be presented in that meeting,  there are several potential outcomes including:

1. Exoneration
2. Probation
3. Reprimand
4. Impose monetary penalty
