State not seeking death penalty in Durham father's murder

DURHAM, N.C. -

A Durham man, accused of murdering a Durham father, will not face the death penalty.

Christopher Hicks, 21, is charged with murder in the shooting death of 22-year-old Jevontez Massey. Massey was shot and killed on Morning Glory Avenue and Belt Street on Nov. 6.

During a court appearance Wednesday, the state said it would not seek the death penalty in the case.

Massey's younger brother told the court that his brother had a one-year-old daughter that he loved spending time with.

"I just want to know the reason why—why they shot my brother," Massey's brother asked during today's court appearance.

A second suspect, 16-year-old Markecio Barker, is also charged with murder in the case.

Hicks is being held on a $750,000 bond.
