Driver charged after car hit by train in Cary

RALEIGH, N.C. -

A man whose girlfriend died after their car was hit by a train earlier this month in Cary is facing felony charges of manslaughter in her death.

Benny Derrick Dimery, 24, of Laurinburg, is charged with involuntary manslaughter in the death of his girlfriend, 22-year-old Lauren Ashley Webb, also of Laurinburg.

Webb was killed Jan. 2 when the car Dimery was driving was hit by an Amtrak train at the intersection of Maynard and Old Apex roads.

Witnesses said they saw Dimery's Mitsubishi Galant on the tracks before it was hit by a train. Cary Police say it is believed that Dimery attempted to bypass the crossing arm.

The Town of Cary said Dimery is expected to recover from his injuries. If convicted, he could face 33 to 41 months in jail.
