Motion to move Randy Taylor trial denied

Posted: Updated:
NELSON COUNTY, VA - Today's hearing in court boiled down to whether suspect Randy Taylor can get a fair and impartial trial if it's heard in Nelson County.

It's a small community where everyone knows or has heard of the victim, 17 year old Alexis Murphy. Taylor's lawyer Michael Hallahan says he did not think the jury could remain unbiased if chosen from this area.

Hallahan made three motions in court today. The first was for Taylor to be able to dress in professional attire for the trial. The judge granted this motion.

The second was to keep any witnesses from mentioning any other missing person cases during the trial. Taylor has been linked to missing teen Samantha Clarke from Orange County, but was never charged in her disappearance. The judge agreed and said no other crimes can be mentioned by witnesses.

The final was a request for a change of venue, which the judge denied. He says if there's a challenge to find a fair and impartial jury than he will consider moving the trial or getting a jury from outside Nelson County.

If the trial is moved at the last minute it could be very costly. Judge Michael Gamble said it would cost a minimum of $100,000 if they have to pay for witness transportation, food and lodging. It's money he says Nelson County doesn't have.
