NC State Fair Vortex victims seek $150 million in lawsuit

DURHAM, N.C. - Four people who were injured in the Vortex accident at the North Carolina State Fair have hired Willie Gary as their attorney and plan to file a $150 million lawsuit against the owners of the ride, according to a news release.

Gary will hold a news conference Thursday at 10 a.m. outside the Durham County Courthouse.

Gary is a Shaw University graduate and a major donor to the school.

His website refers to him as “The Giant Killer” and says he has won “more than 150 cases valued in excess of $1 million each.”

A news release said Gary is representing Kisha Gorham, Anthony Gorham, Justen Hunter and Shykema Dempsey.

The news release said the lawsuit is being filed against Powers Great American Midways and Family Attractions Amusement LLC.

The four were injured in October, when the Vortex started unexpectedly and threw some of them off the ride.

A website looking to raise money for the family says the effort has raised $15,445 with a goal of $20,000. The website identifies Demsey as the niece of the Gorhams. The website said it is being organized by Rahsaan Hunter, who it says is the biological father of Justen Hunter.

The operator of the ride, Timothery Dwayne Tutterrow, was indicted on three counts of assault with deadly weapon inflicting serious bodily injury. Tutterrow was arrested two days after the accident.

The ride's owner, Josh Macaroni, was charged Nov. 6 in connection with the accident. Macaroni is charged with two felony counts of assault with a deadly weapon inflicting serious injury, and third felony assault charge of assaulting a juvenile, the sheriff's office said in a statement.
