ROANOKE (WSLS 10) - A Roanoke County woman charged with a subsequent DUI offense entered a guilty plea in court Friday morning.
Tracie Nininger, 48, was arrested in October 2014. According to testimony in court, her blood alcohol level was .25, more than three times the legal limit.
Just last week on March 26, Nininger's attorney argued that the breathalyzer test conducted after her arrest in October was improperly administered and should not be allowed in court.
The judge denied the motion to throw out the evidence.
Nininger previously served time in prison in the alcohol related traffic death of a construction worker.
This current charge carries a minimum of one year prison sentence with a maximum of five years. Sentencing is scheduled for June 25.
