The former governor's family said that they expect to hear the decision today.

McDonnell has been appealing his case since being convicted on 11 charges of public corruption back in September 2014.

A jury found McDonnell and his wife, Maureen, guilty of accepting more than $165,000 in loans and gifts – including a Rolex watch and designer clothing – in exchange for promoting a nutritional supplement marketed as a miracle cure by Star Scientific Inc.

Both McDonnell and his wife have been free on bond while the pursue their appeals.

If the court decides not to hear the case, McDonnell will have to report directly to prison to face his two-year sentence.

If the justices agree to hear the case, oral arguments could be scheduled for the June session.

A decision by the high court could be made as soon as Monday.
