Henry Co. murder suspect deemed incompetent to stand trial

HENRY COUNTY (WSLS 10) - A psychologist has determined the man charged in connection to a July 2015 murder is incompetent to stand trial.

A judge ordered Benjamin Tovar to receive treatment at an in-patient psychiatric hospital to restore competency.

Tovar, was arrested for second-degree murder in the Dallas, Texas area and later extradited back to Virginia. The victim, Sandesh Rajendra Dhavan, 23, was in the U.S. from India for a work/study program. Dhavan's body was found at the Knights Inn on Virginia Avenue.

On July 28, 2016, at 10 a.m., Tovar will be back in court for a mental review report. On this date, the judge will review a report to see if any progress has been made in restoring competency.

If competency is restored, the court will move forward with setting a preliminary hearing.
