Danville toddler dies; stepmother charged with homicide

Toddler dies in Wisconsin while visiting his father, stepmother

DANVILLE, Va. – This week, 28 year-old Ellen Tran made her initial court appearance in Onieda County, Wisconsin.

She was arrested Saturday afternoon after her story about how 20-month-old Avery Edwards died did not match with the results of the autopsy performed on his body.

The autopsy, court documents show, revealed the likely cause of death was blunt-force trauma to the head.

Tran, however, told investigators the toddler fell Friday night while she was giving him a shower.

Avery was in Wisconsin visiting his father and stepmother for the first time in about 10 months.

A temporary restraining order filed by Avery's mother, who lives in Danville, was recently dropped.

According to court documents, Avery's mother had the restraining order issued against Ellen Tran the last time Avery came back from a visit with his father and stepmother.

The court documents said Avery had bruises.

Prior to Avery's death, an appeal regarding the restraining order being dropped was scheduled to be heard Thursday.

As of Thursday, Ellen Tran was out on a $50,000 bond, paid by her husband, Avery's father.

She is scheduled to have a preliminary hearing on May 25.

WSLS 10 reached out Thursday to Avery's mother and the attorney handling her restraining order appeal but did not get a response.
