Unsafe structure notice remains posted at Happy's Flea Market despite appeal

ROANOKE (WSLS 10) - Happy's Flea Market's lawyers have filed an appeal to Roanoke city staff asking the unsafe structure notice be removed.

Lawyers filed the appeal in June and claim the notice does not comply with the Virginia Maintenance Code because the city has failed to "specify" the corrections owners need to comply.

In the appeal, lawyers claim Roanoke City's Building Code staff didn't provide a list of "all" the defects the owners needed to repair.

Staff on the Roanoke City Building and Fire Code of Appeals heard the appeal in July and unanimously upheld the decision to keep the unsafe structure notice on Happy's Flea Market.

City staff says Happy's owners have not filed any more appeals since July.
