HENRY COUNTY - A Henry County murder suspect's case is moving forward.
Friday, a judge certified Benjamin Tovar's second-degree murder charge.
It will now go to a grand jury in July.
The judge did not certify Tovar's charge of unauthorized use of a motor vehicle.
The commonwealth attorney's office will decide whether or not to reindict Tovar on the charge.
Tovar is accused of killing his co-worker at the Knights Inn in 2015.
In 2016, Tovar was found mentally incompetent to stand trial and was ordered to receive treatment.
He was recently re-examined and found to be competent to stand trial.
