U.S. Supreme Court declines to shield gun maker from Sandy Hook lawsuit

The lawsuit will move forward at a time of high passions in the United States over the issue of gun control. The family members of nine people slain and one survivor of the Sandy Hook massacre filed the lawsuit in 2014. The plaintiffs have argued that Remington bears some of the blame for the Sandy Hook tragedy. Remington has argued that the Connecticut Supreme Court interpreted the exception too broadly when it decided to let the case go ahead. A state trial court initially threw out the claims but the Connecticut Supreme Court revived the lawsuit in March, prompting Remingtons appeal.

Supreme Court lets Sandy Hook shooting lawsuit go forward

WASHINGTON - The Supreme Court said Tuesday that a survivor and relatives of victims of the Sandy Hook Elementary School shooting can pursue their lawsuit against the maker of the rifle used to kill 26 people. Before the school shooting, Lanza shot his mother to death at their Newtown home. The Connecticut Supreme Court had earlier ruled 4-3 that the lawsuit could proceed for now, citing an exemption in the federal law. The decision overturned a ruling by a trial court judge who dismissed the lawsuit based on the 2005 federal law, named the Protection of Lawful Commerce in Arms Act. The federal law has been criticized by gun control advocates as being too favorable to gun-makers.

Gunmaker asks US Supreme Court to hear Sandy Hook appeal

The maker of the rifle used in the Sandy Hook Elementary School shooting asked the U.S. Supreme Court to hear its appeal Thursday of a state ruling against the company. Remington Arms, based in Madison, North Carolina, cited a much-debated 2005 federal law that shields firearms manufacturers from liability in most cases when their products are used in crimes. Citing one of the few exemptions in the federal law, the Connecticut Supreme Court ruled 4-3 in March that Remington could be sued under state law over how it marketed the rifle to the public. The decision overturned a ruling by a trial court judge who dismissed the lawsuit based on the 2005 federal law, named the Protection of Lawful Commerce in Arms Act. "Our state's highest court has already ruled that the families deserve their day in court and we are confident that the U.S. Supreme Court will defer to that well-reasoned opinion," Koskoff said in a statement.
