BEDFORD COUNTY (WSLS 10) - A former Bedford Co. teacher will not be prosecuted for alleged assault and sexual battery charges related to incidents involving former students.
Assistant Commonwealth Sttorney Stephanie Ayers said prosecutors decided not to move forward with charges against Harry Dillard, who was facing three felony counts of aggravated sexual battery and one count of assault and battery.

The charges stem from alleged incidents involving three students under the age of 13, back in the fall of 2012 when Dillard was a physical education teacher at Montvale Elementary School.
In court, all counts against Dillard were nolle prosequi.
Ayers said she made the decision not to prosecute after talking with the victim's families and counselors.
The family of one victim asked to not be involved in the case because of ongoing medical issues. They said they were concerned about the child's ability to withstand the court process and concerned the child would suffer setbacks.
Another child recanted the statement made to law enforcement. The third child is undergoing therapy and the counselor had concerns about the child testifying.
The children were ages 5, 7, and 8 at the time of the alleged assaults.
