Tracie Nininger sentenced to five years in prison, license suspended indefinitely

ROANOKE (WSLS 10) - A woman accused of driving under the influence for the second time was sentenced in Roanoke County Court Monday.

Tracie Nininger, 48, was arrested in October 2014. According to testimony in court, her blood alcohol level was 0.25 - more than three times the legal limit.

She was sentenced Monday to five years in prison with two additional years - both suspended as part of a post release term. Nininger was also be under supervision for two years and her driver's license is suspended indefinitely.

In a March court appearance, Nininger's attorney argued that the breathalyzer test conducted after her arrest in October was improperly administered and should not be allowed in court. The judge denied the motion to throw out the evidence.

Nininger previously served time in prison in an alcohol-related traffic death of a construction worker.
