Case closed against former Buena Vista pastor

BUENA VISTA (WSLS 10) -- The state ends its case against former Buena Vista pastor Larry Clark.

Chief Deputy Commonwealth’s Attorney Christopher Billias has filed a motion to not prosecute additional charges against Clark, who is currently serving a 35 year prison sentence for sexually assaulting a minor.

Billias said his motion is based on the fact that on Tuesday the Court of Appeals denied Clark's appeal in the first case against him.

Billias said the second victim feels justice has been served.

Clark was charged with three counts of indecent liberties with a child and three counts of carnal knowledge. The alleged incidents happened between September 1, 2011 and August 25, 2013.

The cases involved three victims, but it was determined each case would be tried separately. The first trial took place in January.

A second trial for Clark had been scheduled for Monday, September 14 but that will no longer happen now that the state is not moving forward in the case.
