Blacksburg Uber attack leads to arrests and warrants

Uber driver and accuser both face legal battles after altercation

BLACKSBURG, Va. – Almost one month after a road rage incident turned violent, both parties have received warrants for alleged assaults.

“I was served two warrants. One for misdemeanor assault and one for damage to property,” said Andy Earthman. “I was just completely floored. I had no idea what to think.”

Earthman was driving his Uber on December 19th.

While getting over, one man said Earthman cut him off getting over.

That man then followed Earthman to his drop-off almost a mile away. There, he confronted Earthman and the violence started.

Since the incident, Martin McGraw was arrested on January 10th for assault and battery.

Now, he has filed his own complaints on Earthman alleging Earthman assaulted him and damaged his property.

“Evidentially he went to a magistrate and told a story that I had in fact assaulted him,” said Earthman. “That I was the assailant, and that I damaged his property. That I damaged his glasses. He felt threatened when I was driving away from him and that is the reason he punched my car.”

I caught up with Earthman and said when he got the news of the charges, he could not believe it.

“It’s been extremely stressful and extremely frustrating,” said Earthman. “I guess I have to find legal representation now.”

I then went to the Montgomery County Courthouse to look at the records.

In McGraw’s statement to the magistrate, he states he followed Earthman to an apartment complex and confronted him when Earthman dropped off his passenger.

He stated when Earthman went to pull off, he was close to the vehicle and felt threatened, so he slapped the roof.

He then alleges when Earthman got out of the car, he knocked McGraw’s glasses off his face and kicked them under the car.

McGraw then punched and tried to remove Earthman from his car while he was getting back in fear his glasses would break.

McGraw is set to be in court on January 28, 2025.

Earthman is set for court on February 11, 2025.
