ROANOKE, Va. – With under 72 hours until TikTok is banned, the legal battle is far from over for the parent company, ByteDance.
We sat down with a former United States attorney who lives in Roanoke to learn more about what’s to come.
“You’ve got a real constitutional clash here. National security versus the first amendment, it’s a highly charged case. The justices will have to make a decision, and there’s gonna be some sort of business decision if the supreme court does say TikTok has to be shut down.”

Another key part of this whole case is the ban goes into effect one day before President-elect Trump is set to take office. There is a chance the court could extend the deadline so the incoming administration could decide on the ban.
The original legislation passed in 2024 was also a bipartisan effort, which may sway the court in favor of upholding the ban.
